These terms and conditions (“User Terms”) apply to Your visit to and use, of the Site whether through a computer or a mobile phone, the Service and the Application, as well as to all information, recommendations and or services provided to You on or through the Site, the Service and the Application. This document is an electronic record in terms of Information Technology Act, 2000 and rules thereunder as applicable and the provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

By clicking on the “I ACCEPT” button or by using AU Infratech’s services, You are consenting to be bound by these User Terms. PLEASE ENSURE THAT YOU READ AND UNDERSTAND ALL THESE USER TERMS BEFORE YOU USE THE APPLICATION. If you do not accept any of the User Terms, then please do not use the Application or register or avail any of the services being provided therein.

YOUR AGREEMENT TO THESE USER TERMS SHALL OPERATE AS A BINDING AGREEMENT BETWEEN YOU AND AU Infratech IN RESPECT OF THE USE AND SERVICES OF THE SITE.

Your acceptance of the User Terms shall be deemed to include your acceptance of the privacy policy available at auifratech.in By accepting these User Terms, You also allow AU Infratech to send you promotional emails and SMS alerts from time to time.

IT IS HEREBY EXPRESSLY CLARIFIED THAT AU INFRATECH AND THE USER SHALL ALSO BE GOVERNED BY THESE USER TERMS.

1. DEFINITIONS

All of the defined terms in these User Terms will have the meaning assigned to them here below:

(i) “Customer Account” shall mean the account created by the Customer on the Application for availing the Services provided by AU INFRATECH.

(ii) “Leader Account” shall mean the account created by Leader on the Application of AU INFRATECH.

(iii) “Labour/Partner Account” shall mean the account/registration created/obtained by the Labour/Partner on the Application for availing the Services provided by AU INFRATECH.

(iv) “Application” shall mean the mobile application “AU INFRATECH” updated by AU INFRATECH from time to time.

(v) “Commission” shall mean the fee payable by the Customer to AU INFRATECH for the Service i.e., for availing the technology services offered by AU INFRATECH. Commission shall be charged on every booking made through the Site/Application. The Commission shall include the commission payable by labour/partner to the “AU INFRATECH”, which the Customer will be able to deduct from the labour wages.

(vi) “Customer/ You” means a person who has an Account on the Application.

(vii) “Leader” means an individual who shall be assigned a position of Leader, for a group of certain number of workers, by the AU INFRATECH and registered as Leader on the application of AU INFRATECH.

(viii) “Labour” shall mean and include such individuals doing construction works and who got registered as Labour under the AU Infratech’s Application.

(ix) “Partner” shall mean and include such individuals doing electrical, carpentry, sanitary fittings, and other home services as provided under the Application and who got registered as Partner under the AU Infratech’s Application.

(x) “Force Majeure Event” shall mean any event arising due to any cause beyond the reasonable control of AU INFRATECH.

(xi) “AU INFRATECH” or “us” or “we” or “our” shall mean AU INFRATECH PRIVATE LIMITED, a proprietorship firm with registered address at 1014/4, Gurgaon - 122001, which expression shall, unless it be repugnant to the context or meaning thereof, be deemed to mean and include all its successors, affiliates and permitted assigns.

(xii) “Registration Data” shall mean and may include the present, valid, true and accurate name, email ID, phone number and such other information as may be required by AU INFRATECH from the Customer from time to time for registration on the Application.

(xiii) “Service(s)” means the facilitation of the services by AU Infratech through the Application.

2. ELIGIBILITY

The Customer/Leader/Labour/Partner must have attained at least 18(Eighteen) years of age and shall be competent to enter into contract under the Applicable Laws. If You reside in a jurisdiction that restricts the use of the Service because of age, or restricts the ability to enter into contracts such as this User Terms due to age, You must abide by such age limits.

3. REGISTRATION AND ACCOUNT

1. You shall ensure that the Registration Data provided by You is accurate, complete, current, valid and true and is updated from time to time. We shall bear no liability for false, incomplete, old or incorrect Registration Data provided by You.

2. You are solely responsible for maintaining the confidentiality of Your Registration Data and will be liable for all activities and transactions that occur through Your Account, whether initiated by You or any third party. Your Account cannot be transferred, assigned or sold to a third party. We shall not be liable for any loss that You may incur as a result of someone else using Your password or Account, either with or without Your knowledge.

4. SERVICES

The Application allows you to avail multiple services offered by AU INFRATECH.

TERMS AND CONDITIONS FOR CUSTOMER

1. The Application will allow you report complaints of potholes you encounter across the city/state.

2. If such complain is accepted by AU INFRATECH, AU INFRATECH will notify You and further notify agencies/contractors rectify that pothole/ patch and give you an update

3. The Customer shall not misbehave with or abuse the AU Infratech or its representatives verbally/physically

4. Incase there is water logging/ leakage of pipes etc. such complaints shall be rejected by AU Infratech

5. FORCE MAJEURE

AU INFRATECH shall not be liable for any failure to perform any obligations under this User Terms, if the performance is prevented, hindered or delayed by a Force Majeure Event and in such case our obligations under this User Terms shall be suspended for so long as the Force Majeure Event continues.

6. MODIFICATION OF THE SERVICE AND USER TERMS

1. AU INFRATECH reserves the right, at its sole discretion, to modify or replace, in part or full, any of these User Terms, or change, suspend, block, discontinue or restrict your use to all or any feature of the Service or Application at any time.

2. AU INFRATECH shall notify you of any changes made to these User Terms by way of Emails/Notifications on your Applications. The revised User Terms shall be made available on the Site. AU INFRATECH may require You to provide Your consent to the updated User Terms in a specified manner prior to any further use of the Site and the Services.

7. DISCLAIMER

1. You agree that AU INFRATECH is merely an electronic platform to facilitate reporting of potholes/ patches, AU INFRATECH makes no representation, gives no warranty, or guarantee regarding the reliability, timeliness, quality, suitability or availability of pothole repair or their services provided through AU INFRATECH.

2. We do not authorize anyone to make a warranty on Our behalf and You shall not rely on any statement of warranty as a warranty by Us.

9. APPLICABLE LAW AND DISPUTE RESOLUTION

These User Terms are subject to the laws of India. Any dispute, claim or controversy arising out of or relating to these User Terms or the breach, termination, enforcement, interpretation or validity thereof or the use of the Site, the Service or the Application (collectively, “Disputes”) the parties shall attempt to settle the same amicably, through negotiation and consultation at such offices of AU INFRATECH as AU INFRATECH may designate. In the event the dispute is not resolved internally between after at least 30 (thirty) days of negotiation, in good faith, then any Dispute will be subject to the exclusive jurisdiction of courts in Gurgaon, Haryana, India
